Legal Terms of Service & User Agreement

Terms of Service

Last Updated: September 21, 2026 • Effective Date: January 1, 2026

1. Acceptance of Terms and Operating Entity

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and the MixConvert Project Team ("MixConvert," "we," "us," or "our"), an independent digital software project operating the web application located at https://www.mixconvert.com (the "Platform" or "Service").

By accessing, browsing, navigating, or utilizing any feature, tool, conversion pair, or content offered on MixConvert, you explicitly acknowledge that you have read, understood, and agreed to be governed by these Terms and our companion Privacy Policy and Cookie Policy. If you do not agree with all provisions set forth in this Agreement, you must immediately terminate your use of the Platform.

2. Nature of Service & Local In-Browser Execution

MixConvert provides free, client-side digital media format conversion utilities utilizing open-source WebAssembly (WASM) runtimes, Web Workers, and modern browser APIs (such as the HTML5 File API and WebCodecs).

It is fundamental to understanding this Agreement that MixConvert is a client-side execution environment, functionally analogous to a local software application or an in-browser calculator. When you convert documents (such as PDF, DOCX), images (such as HEIC, JPG, PNG, WebP), audio tracks (such as MP3, WAV, M4A), or video files (such as MP4, MOV):

  • The conversion pipeline executes exclusively within your personal computer's or mobile phone's web browser sandbox.
  • No binary files, metadata payloads, or media streams are transmitted to or stored on our servers.
  • All processing performance, conversion duration, memory limits, and file size tolerances are governed by your physical hardware capabilities (such as device RAM, CPU speed, and browser thread limits).

3. License to Use the Service (Personal & Commercial)

Subject to your continuous compliance with these Terms, MixConvert grants you a revocable, non-exclusive, non-transferable, royalty-free, worldwide license to access and use the Platform for lawful personal, educational, organizational, and commercial purposes.

You may convert files for personal use, freelance workflows, agency client deliverables, enterprise operations, or educational research without purchasing a subscription, paying royalty fees, or displaying watermarks. We do not impose artificial daily file limits, forced account registrations, or paywalls for standard conversion features.

4. Intellectual Property & Absolute User File Ownership

We believe unequivocally in user sovereignty over digital content. Under this Agreement:

  • 100% User Ownership: You retain complete, undivided ownership, copyright, title, and all intellectual property rights in and to any and all files, documents, images, audio, or video you import into or generate through MixConvert.
  • No License Granted to Us: Because files never touch our servers, you do not grant MixConvert, its maintainers, or any third parties any license, right, permission, or interest to view, access, copy, modify, distribute, or display your private files.
  • Platform IP: The MixConvert brand, domain name, website design, visual styling, typography layout, proprietary UI components, editorial text, guides, and underlying compilation software are the intellectual property of MixConvert and its open-source contributors, protected by international copyright and trademark conventions.

5. Copyright Compliance, Fair Use, and DMCA Policy

"MixConvert operates entirely client-side within the user's browser sandbox. MixConvert does not host, store, download, cache, or bypass DRM protections for any files. Users are solely responsible for ensuring they possess the necessary legal rights or authorization to convert their files under applicable copyright and fair use laws."

MixConvert is an in-browser media transcoding utility. We do not provide download services for streaming media platforms (e.g., YouTube, Spotify, Netflix), we do not rip copyrighted broadcasts, and we do not provide software intended to circumvent digital rights management (DRM) or encryption mechanisms.

You warrant and represent that any file you process on MixConvert is either:

  • Created directly by you and constitutes your original work;
  • In the public domain within your jurisdiction;
  • Licensed to you under an open license (such as Creative Commons, MIT, or Apache); or
  • Lawfully processed under established statutory doctrines such as fair use (United States Code, Title 17, Section 107) or fair dealing.

Because MixConvert does not store, host, or transmit user files, we have no physical or digital custody of user materials. If you believe intellectual property rights are infringed by editorial text or guides hosted on mixconvert.com, please submit a formal notification to our designated copyright agent at contact@mixconvert.com including the copyrighted work identified, URL of the offending content, and contact information.

6. Acceptable Use and Prohibited Conduct

As a condition of using MixConvert, you agree that you will not:

  • Use the Platform to process, encode, or convert materials that contain child sexual abuse material (CSAM), non-consensual intimate imagery, or content promoting violent extremism;
  • Attempt to inject malicious payloads, cross-site scripting (XSS) vectors, or binary exploits into the WebAssembly runtime that compromise host system stability;
  • Launch denial-of-service (DoS) attacks, scrape backend endpoints excessively, or interfere with other visitors' access to static application assets;
  • Frame or cloak MixConvert within external portals without proper attribution or use automated bots to artificially inflate impressions;
  • Misrepresent your identity or affiliation with MixConvert or falsely claim official partnership or endorsement.

7. Disclaimer of Warranties ("AS IS")

TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, MIXCONVERT AND ALL SERVICES, CODECS, TOOLS, AND CONTENT PROVIDED ON OR ACCESSIBLE THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, TIMELINESS, UNINTERRUPTED OPERATION, FREEDOM FROM BROWSER CRASHES OR OUT-OF-MEMORY ERRORS, AND NON-INFRINGEMENT. WHILE OUR WEBASSEMBLY CODECS STRIVE FOR MAXIMUM ACCURACY AND INTEGRITY, DIGITAL ENCODING INVOLVES COMPLEX MATHEMATICAL COMPRESSION ALGORITHMS; WE DO NOT GUARANTEE THAT ALL DAMAGED, CORRUPTED, NON-STANDARD, OR PROPRIETARY FILE TYPES WILL CONVERT WITHOUT ARTIFACTS OR DATA LOSS. YOU ARE STRONGLY ADVISED TO MAINTAIN ORIGINAL BACKUPS OF ALL CRITICAL FILES BEFORE INITIATING ANY LOCAL CONVERSION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MIXCONVERT, ITS INDEPENDENT DEVELOPERS, CONTRIBUTORS, MAINTAINERS, AFFILIATES, OR HOSTING PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF DATA, CORRUPTION OF DIGITAL ASSETS, HARDWARE MALFUNCTION, WORK STOPPAGE, OR ANY OTHER COMMERCIAL LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE PLATFORM.

BECAUSE THE PLATFORM IS PROVIDED COMPLETELY FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY ARISING UNDER OR RELATED TO THIS AGREEMENT SHALL UNDER NO CIRCUMSTANCES EXCEED THE AMOUNT OF FIFTY UNITED STATES DOLLARS ($50.00 USD) OR THE MINIMUM AMOUNT PERMITTED UNDER APPLICABLE CONSUMER PROTECTION STATUTES.

9. User Indemnification

You agree to defend, indemnify, and hold harmless MixConvert, its individual maintainers, contributors, and technical infrastructure providers from and against any third-party claims, liabilities, damages, losses, costs, and legal fees arising from: (a) your violation of these Terms; (b) your violation of any third-party copyright, intellectual property, or privacy right in connection with files you convert; or (c) any unlawful conduct committed during your utilization of the Platform.

10. Governing Law, Jurisdiction & Dispute Resolution

This Agreement and any dispute, controversy, or claim arising out of or related to your use of MixConvert shall be governed by, construed, and enforced in accordance with standard international internet legal conventions and principles of contract law, without giving effect to conflict-of-law doctrines.

In the event of any disagreement or dispute, you agree to first seek an informal, good-faith resolution by contacting our engineering and legal team at contact@mixconvert.com. Most user concerns, technical issues, or copyright inquiries can be resolved promptly and amicably without administrative friction.

If any provision of these Terms is deemed unlawful, void, or for any reason unenforceable by a court of competent jurisdiction, that specific provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.

11. Amendments & Entire Agreement

We reserve the right to revise, modify, or update these Terms at our discretion to accommodate new WebAssembly features, browser codec support, technical architecture changes, or legal requirements. Updated Terms will be posted to this URL with an updated "Last Updated" timestamp. Your continued use of MixConvert following the posting of revisions signifies your acceptance of the amended terms.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MixConvert concerning your use of the Platform, superseding all prior discussions or understandings.
